Wills

A will records what should happen to your estate, who should deal with it, and who should care for children who depend on you.

Overview

What is wills?

A will is a legal document setting out how your estate should be distributed after your death. It appoints executors to administer the estate, names beneficiaries, and can appoint guardians for children under eighteen.

For a will to be valid in England and Wales it must generally be in writing, signed by you in the presence of two independent witnesses who also sign, and made voluntarily while you have mental capacity. Without a valid will, the rules of intestacy decide who inherits, and that may not reflect your wishes.

Who might this be suitable for?

  • Homeowners and anyone with assets to pass on
  • Parents wanting to appoint guardians
  • Unmarried couples, who have no automatic intestacy rights
  • Clients with blended families or business interests
  • Anyone whose circumstances have changed since their last will

Assessment

What may lenders and providers consider?

Executors

Choose people willing and able to administer your estate, and consider appointing more than one.

Guardianship

Naming guardians for children is one of the most important reasons to make a will.

Types of will

Single, mirror and trust based wills serve different circumstances.

Review triggers

Marriage, divorce, children and significant asset changes all warrant a review.

Criteria vary between providers and can change at any time. Nothing here confirms that a particular lender or insurer will accept an application.
